Fitness Tracker App Privacy Policy

This page applies to the GearedupFitness.com Fitness Tracker App.

1. Categories of Information Collected

General: name, email, age, gender, device metadata, IP address, app usage logs. Sensitive Health Data (APP 3 & GDPR Art. 9): exercise logs, set/rep details, body weight, meal plans, biometric estimates, and health analytics.

2. Legal Basis & Consent

Sensitive health data is collected strictly upon affirmative opt-in consent given via the mandatory signup checkbox. Processing is also required to fulfil paid subscriptions. Consent may be withdrawn at any time via in-app settings.

3. Third-Party Sharing

Payment details are handled exclusively by the Apple App Store or Google Play Store — GearedupFitness.com never stores card details. Data may be shared with cloud hosting and infrastructure providers under strict processing agreements.

4. Cross-Border Data Handling (APP 8)

Data hosted on overseas servers is protected via contractual terms requiring protections equivalent to Australian privacy law. EU/UK transfers use Standard Contractual Clauses (SCCs).

5. Security & Data Breach Notification

Your health and activity data is encrypted in transit and at rest. In a security incident, affected users and the OAIC are notified in line with the Notifiable Data Breaches scheme.

6. Your Rights

You may access, correct, or export your stored health data within app settings. You may request full account deletion, permanently purging exercise logs, meal plans, and related records from active systems.

7. Express Health Data & Third-Party Authorization

When you tick the Sensitive Health & Fitness Data Consent box, you give express consent for GearedupFitness.com, its related entities and its service providers to collect and process your personal and health data to run the app: hosting, analytics, infrastructure, payment processing (handled by Apple or Google) and account messages. Your consent is separate from the Terms, is never assumed from creating an account, and you can withdraw it in Settings or by deleting your account. Marketing messages follow the Spam Act 2003 (Cth) and need your opt-in. Your health data is not sold and is not shared with commercial partners. Any such sharing would only start after a separate, clearly explained opt-in.

8. Contact & Complaints

Privacy complaints may be lodged directly with GearedupFitness.com's designated Privacy Officer, or escalated to the Office of the Australian Information Commissioner (OAIC) if unresolved.
